When it comes to tax investigations, you need more than nerves – you need experts who know and protect your rights.
1. Unlawful provocation during tax investigations
Many searches are not conducted objectively. Tax investigators deliberately provoke people – with psychological pressure, unnecessary comments, or invasions of privacy (e.g., turning on lights, disturbing pets). However, they are not obligated to make statements.
2. Prohibited seizure of private property
Objects such as musical instruments, children's toys, or personal electronics may not simply be taken without a clear connection to the suspected crime. This is disproportionate – and open to attack.
3. No interpreters? Violation of your fundamental rights
International citizens are entitled to a sworn interpreter during a tax investigation. Without one, interrogations and measures are illegal. Nevertheless, translators are often not provided—a common problem, especially in large cities like Frankfurt.
4. No consideration for the hearing impaired – inadmissible
Anyone with a hearing impairment must be given the opportunity to understand everything that is happening. This is a human right – and often already known from tax records. If barrier-free communication is not guaranteed, the measure is unlawful.
5. No or delayed access to files after search
After a tax investigation has taken place, you have the right to comprehensive access to your files. This is the only way to determine whether there is genuine evidence or mere suspicion. Many affected individuals are unaware of this – or receive access too late.
